We're testing options. The initial idea was that it would be the player who has the most Lost Souls in territory (similar to who gets to choose the 1st turn), however we could also go by the player who reveals the most "star" cards or simply use a random mechanic (coin flip, die roll, etc) to choose.
I hope so, I feel that they are necessary for most decks.
Out of curiosity, are we looking to have one of these in every brigade? This brings TC negates to nearly half the brigades in the game, by my count.
Hmmm...that LS intrigues me. Not sure if it will make the cut in most of my decks, but it has potential depending on the current meta.
I thought the Lost Souls cards were banned from tournament play.
I'd kind of like to see most brigade's gain access to a form of Gam's speech. I don't know that means every brigade will get one and it will be something we continue to grow over several sets. I could see leaving out orange and silver so that they have to include a human element to to use them. I like that they still work better within certain themes (Gam's works best on Peter, Kinsmen is recurable in Ruth, FoC works best in FS, this is strongest with Jonah... but he's blue!).

But with some brigade splashing the need for each brigade to have their own isn’t necessary.

I'd prefer to encourage the differences between brigades whenever possible, especially with mechanics that it feels like each brigade has to have. For example, a TC Red warrior that lets their owner discard a Red weapon from territory to do the same efffect as Gam's Speech. Or a magician that lets the owner discard their generic demon to get Gam's Speech effect. Or a [EDITED BY R.O.S.E.S] that captures a good prophet in your territory. (These would all be 1-time uses as well)
