Sites In and Out of Battle

Here is a situation needing adjudication...

I have a Lost Soul sitting in a red site.

My opponent has The Ends of the Earth in territory (actually sitting on the divider between territories in RTS), brings the NT Gabriel into battle and declares RA. TEotE is the only possible way Gabriel could have access at this point.

I block with Zimri and discard a Crimson enhancement to discard all cards in battle.

My opponent discards Gabriel but leaves TEotE in territory. I ask him to discard it and he says it was never in battle.

OK. So before I blocked, I could have asked how exactly Gabriel had access for an RA and forced my opponent to explicitly bring in TEotE. The question is, in the situation above--do I have to ask my opponent the question--or is his declaration of RA sufficient to assume that TEotE was in battle?

Second related question--my opponent claimed that you can bring sites into and out of battle as you desire. While I understand that at any point (with or without initiative) you can add a site to battle, the REG says,

Quote from: The REG Site Access Cards -> How to Use
Site access cards in battle may not be removed prior to the battle resolution unless forced or allowed by another card.

Doesn't this mean once a site is in battle it stays in battle until the end (or an SA removes it)?

If your opponent declared a rescue attempt and they needed the site for access then it was there whether they physically moved it or not.  I would be discarded by Zimri unless they could negate his SA.

Sites can be added to battle from territory at any time but not removed.  Once it's in battle it stays unless a special ability removes it.

If a Site is required to access a Lost Soul for a rescue attempt, it must be in battle.  If this is going to be a point of contention, it may be time to start playing the grumpy bear and start asking your opponents how they have access, and/or insisting they physically place the Site into battle before responding.  There are enough cards now that affect cards in battle that people need to pay attention to this.

Hmm...I always thought if you neglected to bring in the site it was a battle challenge, i say I don't accept and you missed your shot....ESPECIALLY at Nats....when did this change? Or was it simply misunderstood? ( I could have won many a LS if I could have technically allowed to bring in my site when I forgot...)

The site can be added at any time, as someone can gain access during battle (via a site drawn due to a Reach or something of the like).  It may just be a battle challenge at that point, though.

You're correct that a site can be added to the battle at any time to gain access, but only if it's added from territory.  If your site is still in your hand because you forgot to put it in play, or if you drew it during the battle, you cannot add it to the battle.

This quote from the REG assumes that you had access initially but the principle is the same.

Quote from: REG > Ongoing Abilities > Site Access > How to Use
If you lose access to your opponent’s site during battle, you may place a site already in play into battle to regain access.  You do not need initiative to do this.  However, you may only put a site into battle that is already in play (i.e., not from your hand).  Multiple site access cards may be placed in battle at one time.  If you cannot regain access to the site, the battle is no longer a rescue attempt, but rather a battle challenge.

Oh, I hadn't realized that.  Makes sense.

In retrospect that is what I should have done, since I would have done so playing f2f. I guess RTS just brings out my lazy side.
