You may not have character cards with the name of the same person in your territory, set-aside area or in the Field of Battle at the same time.
Duplicate CardsNo player may control duplicates of a unique character or cause them to fight each other. This includes unique characters in play, in battle, in a side battle, face down, or in a set-aside area. Character cards with the same card title and the same art or with the same title and the same brigade are considered duplicates for deck building purposes. A player may have only control one of these at any time. The only exception to this rule is non-unique characters with different card art.

Why not just place 2nd Naaman in your territory and choose to discard the hero Naaman?Thats basically what you are doing in your battle except you are killing your own hero.
No. Your opponent could have Michael in their territory and also be forced to attack with your Michael. There is no conflict because they do not own your Michael. They control both, but they do not own both, therefore, they do not "have" both.
