I ra with a hero (no band).  My Opponent blocks with a lower numbered EC (no band) and plays an enhancement, but my hero stays in battle.  My Opponent CM's my hero, can I play Grapes on his EC, no-one is left to shuffle though, but shouldn't I get another battle phase as long as my LS's are < = to his?

Yes, you can play it. "Shuffle all remaining", much like "discard your hand", does not specify a number/minimum, so 0 is an acceptable amount to "shuffle".

so u can also play it after your hero is discarded, shuffled, captured, returned, etc. due to enhancement during battle?
