I ra with a hero (no band). My Opponent blocks with a lower numbered EC (no band) and plays an enhancement, but my hero stays in battle. My Opponent CM's my hero, can I play Grapes on his EC, no-one is left to shuffle though, but shouldn't I get another battle phase as long as my LS's are < = to his?

I would say yes.
If your opponent has time to play SoG NJ, Burial, or CM after you kill their evil character, the reverse should apply.

Yes, you can play it. "Shuffle all remaining", much like "discard your hand", does not specify a number/minimum, so 0 is an acceptable amount to "shuffle".
