Does the herod with Herod's Trech have to be in battle in order to discard it to cause a hero to retreat?

Place on a herod *yaadddaaaa* You may discard this card to make X heroes withdraw from battle.

Yeah, it wasn't quite intended to have that kind of power but in hindsight, it gives the Herods a nice shot in the arm to jump-start them as a defense.

Kinda like how we allowed teal to catch up to the other brigades by making them invincible  ::)
