If my opponent has no EC's in play and put Foreign wives in play do they D/C 7 off the top or one?

The counter appears to be based on Evil characters to me but I am just double checking.

I agree, seems like it should be one to me. It's worded as a single yes/no condition being checked.

The trigger is playing the EC. The check is, does it have a brigade they do not control. If yes, the discard happens based on the EC played, not the number of uncontrolled brigades.
