Okay, so lets so a hero is making a rescue attempt, and the player plays an enhancement that causes two evil charachters to fight each other.
Who chooses who controls which evil charachter in the side battle?
We've been playing it that the player creating the side battle chooses, and almost always chooses the lower number EC for himself, and a bigger EC for his opponent, and then just passing because he would have init.
Is this right?

Just for clarification. I heard of people thinking that they could pass because they have inish.
You can only pass If It's Mutual or Stalemate.

right if you are in losing situation and you "pass" initiative that is pretty much conceding the battle.

Correct, with a couple caveats. If you chose one of your EC's and one of your opponent's EC's, you must control yours and your opponent must control his. If you chose an EC in battle, your opponent must control it (does not apply if multiple EC's are in battle and you choose to make them fight each other).
