If I attack with a red hero, play Battle Cry (http://www.redemptionreg.com/REG/Master/battlecrypa.htm), and band to Angel under the Oak (http://www.redemptionreg.com/REG/Master/theangelundertheoakra2.htm) and Gideon can my opponent kick Gideon out of battle by negating Battle Cry (http://www.redemptionreg.com/REG/Master/battlecrypa.htm)?

No, simply because the exchange for Gideon is CBN.

I don't think that was the question (but I agree with the answer if it was). I think Battle Cry is supposed to band in Angel under the Oak and Gideon (no exchange, or for someone else), in which case you should be able to kick Gideon out of battle by negating Battle Cry.

That's true, if Gideon is banded into battle instead of exchanged, he can be kicked out by negating the band, despite being protected. It's the same as the Cheribum + ET + PoA vs 12 Fingers ruling that came after a dozen or more pages of debate. :)

But isn't this a different situation because this time the protection is CBN?

No, because Gideon and his protection are not being targeted, only the banding ability is targeted.
