Does the magician with Magic Charms activated on it, have to be in battle for the discard feature to be active?

No.

No. you can even use it to capture their Heros when your Hero is in battle(at least that is what I was told).

This is also correct. Because of the wording on Charms, you can capture your opponent's heroes during your battle phase.

VS. a Watchful Servant deck you can make a rescue, use charms, and capture their WS. Game Over.

Until they pull out The New Covenant or I am Redemption or Covenant with Palestine or have Blue Tassels up before it's your turn. Yes, I agree with all who posted above saying that you can use Magic Charms during your Battle Phase.

Between Destruction, and CA(which should be in every deck(imho)).  Those aren't reliable enough.

If you play magic charms while YOU are in battle with your own hero, then you can capture WS if he is in play, if I understand it correctly.
