Magic Charms
Artifact
IDENTIFIERS: May be activated on your Magician
SPECIAL ABILITY: Protect your Magicians from capture and conversion. You may discard this card from your Magician during battle to capture up to two human Heroes.
For the capture portion, is it the Magician doing the capturing or the Artifact?
Does the Magician who has Magic Charms placed on it have to be in battle to use the capture ability?

The charms. I don't know about the 2nd question.

The charms do the capturing. Like all artifacts, they don't have to be in battle to be used.
During testing this originally didn't have the "during battle" clause making it just a little OP since it could be activated and used before any player even had a chance to use DoN. I think at one point it even captured X Heroes where X was the number of Magicians you had in play.
