I need a ruling for a recent game I just played.
I site lockouted my opponent and I had two lost souls in my territory, both in green sites. The only way he could get access is if he had a green hero, and the only one he had was Hur who was in his discard pile. So he activated Chariot of Fire and made a battle challenge because he didn't have access. The thing is though, he says that every time you put a hero in battle it starts as a rescue attempt, even if you don't have access to any lost souls. The rescue attempt "fails" and he gets to shuffle Hur into his draw pile. I don't think he can do this because on Chariot of Fire it says you have to make a rescue attempt in order to shuffle, but he couldn't rescue because he didn't have access. What do you guys think?

You are right... tell El Vacca that The Spy says so. There is a difference between a Battle Challenge and a Rescue. If you can, DoN his Gifts of the Magi for his insolence, just out of spite next time. ;)

Thanks, yeah that's what I thought. lol
I kept telling him, how can you make a rescue attempt if you don't have access? That just doesn't make any sense

Every battle is either a battle challenge or a rescue attempt. If you have or gain access at some point in the battle, it is a rescue attempt at that time. If you never have access, it is only ever a battle challenge.

What if you lose access in the middle of the battle while you have CoF up? Would that technically be considered "following rescue attempt," and you would get to shuffle right there in the middle of the battle? (Expecting a verdict of "no" and a long explanation. ;))

It was a rescue attempt at some point during the battle, so yes.
If a battle is EVER a rescue attempt, then all the end of battle stuff that refers to rescue attempts will apply. That includes a use of Chariot, a "failed rescue" that would trigger I Am Patience or gold Panic Demon, etc.
