If you are losing the battle due to a capture ability when you are making a rescue attempt, would you be able to play "the battle is the lord"?

Battle of the lord: If used by a warrior class hero, negate all specials abilities on evil enhancements of a selected brigade. (I couldn't find this particular card in the reg)

Since you are losing the battle by the capture ability and you have the special rule to play either a negate or interrupt, would you be able to play it?

If you're using it on a warrior class hero, yes.

EDIT: Also assuming an enhancement is capturing you, not an artifact/character/etc.

It's under "the," not "battle."
