This isn't really all that new, a friend of mine received a cease and desist order from Time Warner when they caught him torrenting, and they trottled my upload speed several times when I was running a web server out of my house because lots of upload data is usually a dead give away for torrenting.

New or not everybody should know. Like I said this could get bad fast.

Not really. All they're doing is monitoring bandwidth. This is something colleges have been doing for years now, and it sounds like they have a pretty good system set up. I'm all for pirating, but if this is the way it dies, I'm okay with it.

This will not kill pirating, it will only kill the casual pirater. It doesn't take much to know to throttle your own upload speed to hide the torrents.
