Set Aside cards in territory

So until just now I thought you could only play set aside cards in territory that targeted your own dudes, turns out you can actually play any set aside cards you want they just can't target opponents cards with their set aside ability. What does this mean for cards that have a set aside ability (so they could be played it seems) in addition to another ability that theoretically would still function like Brother's Envy (Set aside a male Hero for 3 turns. If Pit of Dothan is in play, you may capture a male Hero regardless of protect abilities instead).

This is obviously not the intended way for the game to work but going strictly off the current REG can I not play Brother's Envy in territory since it's a setaside card then use the capture ability on my opponent's character?

My guess is that you can’t carry out an instead effect if your unable to carry out the original effect it is supposed to replace.

Pretend I thought of an example with fewer variables like Magnificat (Negate special abilities on characters. If used by a musician or N.T. female, set aside an Evil Character in battle for 2 turns). This one may also not be a perfect example so what if for the sake of the example there was a non-territory class enhancement that said "Set aside a Hero for 2 turns. Discard a Hero in a territory." Can I play that in territory (because its a set aside card) and then discard a Hero in a territory (because I'm only restricted from targeting my opponent's cards with set aside effects)?

I’m not in a place to search the REG right now, but assuming it says what you’re telling me it says it would seem that way. I doubt that is the intention and image it will be corrected with the next update.
